Ok , So I ran into someone I went to high school together with and now is a cop. Me and him was talking and I was telling him I knew someone that had gotten pulled over for a simple tag violation . Once the cop got to the window and saw my friends gun on his person , he asked the guy to step out of the car but keep his hands where he can see them.
Once out without asking or anything he (cop) reached at the gun and took it .Told the guy to get back into his car so he can run the information .
I was telling my friend how he violated his 4thA and that he is now trying to sue the department for doing so. So I asked the cop what if the guy didn't allow the officer to take his gun off his person without a warrant or getting permission from the guy. He said well I would have told him for my safety while I am running your information I would feel safer you not having a gun while I do that.I said what if the guy said the same thing about you having a gun as we been seeing a lot of trigger happy cops lately . He said NO WOULD NOT HAPPEN !
I said ok and the guy says no to you what would you do. He said short and simple he would be going to jail. I said for what cause he stated if he had a permit to carry and nothing illegal just the tag light . I said that's not a offense to be arrested , he stated ALL violations is an arrestable offense .Once under arrest for the tag , he can now search the vehicle .At this point , I had to leave so ended with this ,
If you arrest me for a tag violation , because I didn't want to give up my 4thA and my 2ndA I will see yall in court .


SO MY QUESTION IS THIS , seeing many say they would fight for their rights, and if you don't give them up that these cops can twist the law and do what ever to us to make us give them up , or is this some sort of black mail and can get an officer fired?

I would try to get them properly educated, not fired. If the problems still exist after a proper education I would push for termination then.

Sadly, not. Until some time in the distant future when there's been a sizable dent made in the "training issues" that affect so many (read: not ALL) departments in Georgia and across the country, get used to being treated like a criminal for lawful conduct is all that I can say. Or, do your best to avoid all contact with LE, which is what I do. Fact is, many departments seem to have adopted the policy of illegal search and seizure for lawfully owned and carried firearms discovered during a traffic stop. They know its unreasonable and a violation of our rights; they also know that there isn't much that the citizen can do about it.

Moved to Off Topic. Hypothetical what if I encountered an LEO while armed does not belong in LEO Encounters, nor does I asked my friend LEO what if.

Reserve LEO Encounters for actual encounters with LEOs while armed, please.

As I encountered a Leo which happen to be someone I went to school, and my friend encountered also which I am also talking about. :screwy:

Were you armed at the time? and was that fact a point of contention in your discussion?

armed as always , OC He came over to me and was like Hey do I know you . Then started talking. But that is beside the point as it was clearly posted about my friend encounter . As I have seen tons others post about my son, father,mother,wife encounters but yet moved to the off topic . Which this is clearly on topic discussion . But Oh well I thought many should read this as it's very important as many of us think we are with in rights but then they can flip (black mail us) in doing what they want.
Give your friend a copy of Stave v Jones and let him have some time to digest it. Then ask the question again.

MY COMMENT: I'm going slightly off-topic here, but do y'all realize that most minor traffic violations in Georgia are CRIMES that can get you up to ONE YEAR in jail?
I don't recall off the top of my head which ones, but I know a lot of them are.
Just because the normal and usual "failure to maintain lane" violation gets you a ticket with a small fine just like a speeding ticket, that doesn't mean the law treats those offeneses equally. Some carry draconian penalties, and we are lucky the government doesn't try to take advantage of that enormous power the legislature has given them.
Rack up any three motor vehicle violations at once in ATL and I believe you will be arrested. at least that was explained to me by a cop when i had an expired tag once and didn't have an insurance card in the car.

You don't need a permit to carry in your car so I'm not sure why that matters.

The reason why is because it shows your legal to carry anywhere and that he has been threw the process of a background and was approved from the Gov.Versus the cop thinking he is a convicted felon or something. :wink:
