Wisconsin lady who carried gun in church sues, cops settle

The story.

Here is the complaint. They settled for $7500.

It looks like jrm got another settlement.

$7500 is pretty weak, but it's a win. WI LEO are *INSANE* with their treatment of people legally open carrying. I just moved from outside of Brookfield where this took place to Atlanta, and OC issues were in the news constantly.
Comments are pretty scary.
Can someone explain why he refers to the 14th amendment when referring to illegal searches and seizures and not the 4th?

It comes from the following in the 14th
Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws
Since it was a State infringing on her rights as a citizen, and not the Fed... it falls under the 14ths restrictions on the State. Were it the Fed violating her, it would fall under the earlier amendments.

Because as far as they are concerned, there is no 4th amendment....
The defendants settled for $7500 because that was cheaper. Lost time from work, attorney fees, expert witnesses, travel, and the possibility they would lose have to pay a large award or spend more money and appeal. Plus, this way they didn't have to admit wrong doing.

They need to look back a few years to where a kid went into a church mass being held in a hotel conference room IN BROOKFIELD (where the report was from) and killed like 5 people...

But of course, this couldn't happen because guns aren't allowed in a church...

Incorporation. The only reason the 4th amendment applies to the State of Wisconsin (or any other state or local government) instead of just the federal government, as interpreted by the U.S. Supreme Court, is the ratification and incorporation through the 14th amendment.

Well Caryl, it looks like your church has made it clear that it is a gun-free zone. You do know that criminals intent on hurting people like to bring their gun with them to gun-free zones, so as not to have anyone shoot back at them.

Had such a wicked person tried to cause harm at your church, and Krysta Sutterfield defended you with her gun, I guess you wouldn't be harping about her gun being brought to church, you hypocrite!

Hey, psst - I got a secret for you...don't tell anyone, but when you're out and about during the day, there are decent regular citizens carrying concealed firearms that walk right by you, within inches. Oh! The horror!
All this may be a mute point soon. Wisconsin is getting a new governor and he supports constitutional carry. Their legislature has already passed it twice and the former governor vetoed it. If it passes again I believe the new governor will sign it. This will give the citizens of the "badger state" the right to carry concealed if they want to.

Is this the SAME "9 millimeter Glock handgun" she is shown holsetering? because that is no Glock. It is a Kel-tec P-11. (perhaps the Glock was confiscated and that was not mentioned in the report?)

JRM- Way to go on settlement. BUT, did the rest of the requests for restitution get met? (statements etc as stated in brief)

Phil... in Cheese Head Land, concealed carry is illegal. Open Carry is legal though without a license. The WisconsinCarry.Org crew is pushing Consitutional Carry which would be a little step from where they are right now by just deleting the open to view requirements

Constitutional Carry in Georgia is a bigger step. Since it means getting rid of licenses. There are lots of entrenched interests in the licensing process that won't give up easy. Plus getting the AJC would have a field day with the Republicans if they pushed it. Sadly.
