Just now sent them this email:

Dear VHCA Officials,

I saw this on your website:

"What Should I Not Bring Into Summerfest?
Alcohol, Weapons, Pets, Bicycles (o.k. to valet or lock-up outside festival), Skates, Skateboards, Scooters, Oversized Backpacks, Picnic Coolers, Folding Chairs, Grills, Illegal Substances or anything else the police at the entrances may deem not in the best interests of Summerfest. All bags are subject to search by the Atlanta Police Department."

Perhaps it was an oversight, but in case you didn't know, state law in Georgia is that weapons enjoy statewide preemption. This means that citizens who are licensed to carry may lawfully carry weapons in all places except where state law specifies they cannot be carried, or where those in control of private property ban weapons.

Last time I checked, the street where Summerfest is to be held is neither specified as off limits to weapons under state law, nor is it private property.

Additionally, I don't believe the Atlanta Police Dept is deficient in understanding Fourth Amendment protections. They know they must have probable cause of a crime in order to detain and search the property of citizens.

Should I expect that you will correct your website to remove the prohibition of weapons? Or are you merely suggesting they should not be brought, even though you know they are legal to be brought? Could you please clarify your position on whether you believe you can actually ban weapons on a public street? Has the city approved of banning weapons during the festival?
