Sugarloaf Mills now off limits due to HS extension?

    Gwinnett County schools is opening a Phoenix High School extension in collaboration with
    the Simon Youth Foundation.

    Apparently some of the space is being converted to classrooms.

    What does this mean in regards to carry?

    Interesting that Bass Pro Shops is an anchor and sells all kinds of firearms, ammo, and accessories. Also Medieval Times is also located at the mall and sell various types and sizes of edged weaponry.

    They probably, incorrectly, believe that since they have a company policy (Simon Malls) nationwide not allowing weapons that it changes nothing.

    It will be interesting to see what happens with Bass Pro. They have no problem with open carry in their store. Will they become off limits for carrying in any form due to the school system taking over some of the empty business spaces to use as classrooms inside the mall? They are saying that the class hours will be 8am-6pm Monday thru Friday and some weekend classes might (probably will) be added in the future.

    I thought for it to be off limits, it had to be property owned or leased by the school. They aren't leasing the whole mall, nor the Bass Pro.

    And that "should be" the final word on the topic of a high school setting up in some suites of a shopping mall, but:


    Are parts of the mall outside of the school's leased space nonetheless off limits when used for school functions? Maybe the food court, the administrative mall offices, and other common areas of the mall?

    Remember, for K -12 schools, this definition applies:

    (2) “School function” means a school function or related activity that occurs outside of a school safety zone and is for a public or private elementary or secondary school. [emphasis added].

    Notice that a "school function" does not have to be a field trip, or a seminar, or other educational event. It's only got to be a school related activity done for the school.

    A related potential problem:

    No matter what we (well-informed gun rights activists) know the law to be, the great masses of people out there (including most cops) may not know all the nuances of George's firearms laws in general in the school weapons law in particular .

    So when a parent of a student calls 911 to report a man with a gun at her daughter's high school, I can imagine a strong and dangerous police response, SWAT roll out, 3 hour lockdown.

    Later, we'll see both school officials and mall management complaining on the 6 o'clock news that some obscure loophole in the law apparently prevents them from prosecuting the offender-- the only recourse is a criminal trespass ban from Simon Properties directed at the specific persons involved in the incident that day.

    Carrying weapons within school safety zones, at school functions, or on a bus or other transportation furnished by a school



    (a) As used in this Code section, the term:

    . . .
    (3) "School safety zone" means in or on any real property or building owned by or leased to:

    (A) Any public or private . . . secondary school . . . and used for . . . secondary education . . .

    . . .

    (e) It shall be no defense to a prosecution for a violation of this Code section that:

    (1) School was or was not in session at the time of the offense;

    (2) The real property was being used for other purposes besides school purposes at the time of the offense; or

    (3) The offense took place on a bus or other transportation furnished by a school.

    (f) In a prosecution under this Code section, a map produced or reproduced by any municipal or county agency or department for the purpose of depicting the location and boundaries of the area of the real property of a . . . a private . . . secondary school that is used for school purposes . . . , or a true copy of the map, shall, if certified as a true copy by the custodian of the record, be admissible and shall constitute prima-facie evidence of the location and boundaries of the area, if the governing body of the municipality or county has approved the map as an official record of the location and boundaries of the area. A map approved under this Code section may be revised from time to time by the governing body of the municipality or county. The original of every map approved or revised under this subsection or a true copy of such original map shall be filed with the municipality or county and shall be maintained as an official record of the municipality or county. This subsection shall not preclude the prosecution from introducing or relying upon any other evidence or testimony to establish any element of this offense. This subsection shall not preclude the use or admissibility of a map or diagram other than the one which has been approved by the municipality or county.

    And the asshats at Gwin Co already said that the food-court is open to the students for their meals on their official page. Methinks that the Simon Mall folks have other motives than being "good citizens" for allowing the county to use unused and unrented space for HS classes........

    I thought I recalled reading a code separate from 16-11-127.1 that said if a county school district leases or rents part of a building for classrooms, the whole building itself is considered a school. I can't find it as of yet so maybe I am remembering it wrong.

    That is why I posted the title as a question. Is the whole mall of limits, or is 16-11-127.1 the controlling code. And if so, it would appear as if the food court area is now off limits 24-7.

    Surely Bass Pro knows about this threat to their operations at this location. Seems there’s a risk the whole mall and parking lots could be off limits, not to mention Bass Pro would have to stop selling weapons and ammo. Could this possibly be a simple oversight?

    Given that Bass Pro Shop, at least, sells weapons it would be very hard for the Simon Mall folks to make such a demand without negative financial impact on them. Personally, I hope that there is such a law and the BPS is barred from having weapons on the property. Perhaps that will force Simon Malls to reconsider being Anti-2A.

    With all of this talk about Bass Pro, it's getting interesting. They have big money. They give big money to their landlord. Money talks, and greed runs the world. They can either get the law clarified/changed, or their corporate lawyers will take care of everything in some other way. Or maybe nobody will do anything. And then some poor schmuck will have his entire life ruined, while his and other lawyers just get richer. That's how things work in this extremely corrupt legal system that ignorant people call a justice system. It's all a freaking racket.

    Bass Pro may own their store outright meaning even if the entire mall is off limits, Bass Pro might not be since even though it's connected, it may be considered a separate building.
    To the bolded, you're joking right? Losing one anchor tenant at one mall is nothing to them. They have $31 Billion in assets, and make $5.4 Billion in revenue each year.
