Am I jumping the gun (pardon the pun) or have they decided to hear it?

There's still no official confirmation. This will be a big win for us if they choose to hear it.
I think so. It's one of the things they could hear, but the session just starts this AM.
I don't think all the briefs are in yet. Hellers reply to DC's Cert. still has this week to be filed, if they are going to file one.
There has not been cert grant yet. Respondents (Heller) have until Oct. 5 to file their brief in opposition (which won't really be in opposition), and the Petitioners have until around Oct. 12 to file their reply on the cross-appeal. Then it will be considered at Conference in early November. Patience is necessary.
