Busy January 16, 2023? If so, change them. Get a group to ride up. Put together a GA2A flag and get in on the festivities. Its about 530 miles from Atlanta to Richmond, straight up 85 to the last 30 or so on 95 and downtown Richmond. Bring a jacket, it might be a bit colder than you are used to down there. Gloves and a hat might be good too. It could be raining or you might experience snow.

1. VCDL Lobby Day 2023 is ON!


VCDL Lobby Day will be on Monday, January 16, 2023 at 11am at the Bell Tower in Capitol Square.
Mark your calendars and get the day off, if you work! (It is on a federal holiday, so you might already have the day off. And, yes, the General Assembly meets on that holiday.)
This fight for our rights won’t win itself. WE must all be engaged. A strong Lobby Day turnout will help VCDL as we lobby to reverse the unconstitutional gun control that was passed in 2020 and 2021.
2023 won’t be an easy year in the General Assembly, since the anti-gun Democrats still control the state Senate by one vote. But the Bruen ruling is going to be very helpful in righting the Ship of Liberty, hopefully starting in 2023.
Let’s stand together on January 16 to send a strong message of gun-owner unity and determination!
More details will follow as January 16 gets closer.


2. Action Item: Surry County working on local gun-control!


Surry County wants to be just like Fairfax County and pass local gun-control to show its distrust of Surry County gun owners, including CHP holders.
Currently only 16 out of 194 localities have passed such an ordinance.
What’s troublesome is that Surry County is a Second Amendment Sanctuary and has been since 2019:

The City of Winchester and Fairfax County are both being sued over having the same kind of ordinance and the recent Bruen finding by the U.S. Supreme Court is also a very bad omen for Surry County’s proposed gun-ban.
The public hearing on the ordinance is going to be on Thursday, October 6 at 7 pm.

  • How does prohibiting those who are peaceful citizens from carrying a gun for self-defense make them, or anyone else (except criminals), safer? You want to target CRIMINALS, not ME!
  • Only 16 localities have implemented such an ordinance out of 194 localities and none of them rural like Surry County. What issue has Surry County had with citizens lawfully carrying guns in the locations in the ordinance?
  • The City of Winchester and Fairfax County are being sued over that same ordinance. The recent U.S. Supreme Court ruling in the New York Rifle and Pistol Association Inc. v Bruen has made it clear that such a ban on carry in places like parks, permitted events in public areas, community and recreations centers, and other non-sensitive government buildings is unconstitutional.

4. R.I.P. Jeff Picchi, owner of the Smoking Gun in Colonial Heights


It’s with a very heavy heart that I must report that Jeff Picchi, the owner of the Smoking Gun shooting range in Colonial Heights, died unexpectedly last Tuesday from a heart attack.
I was fortunate enough to have spent about 20 minutes talking to Jeff at his range only two weeks ago. I had no idea it would be our last conversation in this world.
I’ve known Jeff for many years. He was a patriot and a family-man who always stood up firmly for his beliefs. He was also a kindhearted and generous soul. He’d give you the shirt off his back if you needed it.
His memorial service is going to be held at 5pm on Thursday, September 15 at:

5. “No guns” park sign fails in Richmond


The sign never stood a chance of stopping criminals. Just “security theater” to make it look like Mayor Stoney was actually doing something about crime.

6. BATFE document reveals registration scheme for pistol braces [VIDEO]


Looks like the BATFE is setting up to make a pistol with a pistol brace an NFA short-barreled rifle. If so, you will have to register the pistol, but without having to pay the NFA tax if registered in a timely manner.
I’m hoping the NFA, as well as the ban on bump stocks and the registration of pistol braces, will all be struck down over time thanks to the Bruen ruling.
In the meantime, you’ll have to decide what you wish to do should the registration scheme become a reality. Your options are to register the brace and pistol as a short-barreled rifle, destroy or give up the brace to the BATFE, or do nothing and take your chances with the legal system (if successfully prosecuted, you could face 10 years in prison and up to a $250,000 fine).
Interesting note: if you do register your pistol with the pistol brace on it, you would then be the proud owner of a short-barreled rifle. You could throw away the brace and put on a sliding stock, add a foregrip, put on rifle sights, etc.

1. VCDL membership meeting in Loudoun County THIS Thursday, Sept. 15


The third Thursday of this month is this coming Thursday, September 15, so VCDL will have its regular membership meeting at the beautiful facility at XCal in Ashburn:

The meeting is called to order at 8 pm.
Come early (6pm-7pm) if you want to shoot and/or eat before the meeting at the XCal Cafe. VCDL members get $5 off a lane on meeting night.
Delegate John McGuire, a candidate for the Virginia Senate in 2023, will speak briefly about his candidacy and take any questions.
We will be discussing current events relative to firearms in Virginia, including the issue with credit cards flagging gun store purchases.


2. ACTION ITEM: Credit cards to monitor purchases from gun stores


Gun stores are going to get a special code for use by credit card companies to indicate a purchase at the store. The code does not say what was bought, only the amount spent. It could be a gun, ammunition, a gun safe, a knife, etc.
Some Congressional legislators, including two from Virginia (see below) pressured the card companies to adopt this policy. New York also pressured them.
While the new policy (not yet in effect) does not seem extremely troublesome, it can lead to things that are bad news. For example, a credit card company might decide that you spend too much money at gun stores and cancel your card.
The card company could also prevent purchases at gun stores, similar to what PayPal has done.
Supposedly this change is so credit card companies can flag suspicious customers and report them to the police. But since they can’t tell what you bought or in what quantity, how can they possibly flag you for anything? This sounds like virtue signaling that can be used for a more devious purpose down the road.
Member Fred T. sent me this as a work around for not using your credit cards to buy guns or ammo:
Buying products at gun stores might be best accomplished using a "Gift Card". As a bonus, you might realize a discount for using the store’s gift card. A gift card has a special Visa, Mastercard, and American Express "PRODUCT CODE" that would be reported instead of a gun store code.
So, if you wanted to purchase new or additional sporting goods or outdoor gear, buy a gift card first.
Of course, if you purchase locally you can pay with cash. You could also use a money order or a cashier’s check if ordering remotely or locally. That would, of course, slow down the ordering process.

Let’s contact the three major credit card companies to protest the new policy of flagging sales from gun stores.
The point to make is that gun ownership is constantly under attack by those who don’t like guns. The new policy on tracking sales at gun stores could be used in the future to restrict the right of law-abiding citizens to purchase guns and ammunition. The policy could also be used to shutdown gun stores by denying them any credit card sales. Urge the card companies, politely, to not implement the new policy.

4. VCDL-PAC Top-Gun event wrap up


The VCDL-PAC held it's 2nd annual Top Gun Competition Fundraiser this past weekend. The weather was good, and the competitors were great! We enjoyed fellowship, good food, and were blessed with the King George 4-H Shooting Team, who coached anyone who wanted to try their hand at sporting clays.
The action in the dueling tree competition was friendly but fierce. It's a fast-paced race to see who can get all the steel paddles on their opponent's side of the stand, and the last man standing took home a cool grand in cash.
32 competitors vied for the top prize. Once the field was narrowed down to four finalists we ate lunch and then held the semi-finals and finals. You can watch them on the VCDL YouTube channel here:
Hats off to the deputies from Stafford County for getting first and second place! Deputies from Chesterfield, Powhatan, Goochland, York, Grayson, and Cumberland counties also participated, along with other shooters.
The event raised money for the VCDL-PAC, which will be used to help elect candidates who will fight for your rights. Watch for next year's event so you can come out and join the fun!

This is an interesting case, which breaks a stereotype. Two women in a forest claim their car has broken down. Generally, you don’t think of women committing violent crime, so a person may not have their guard up. If a woman is involved in a violent crime, it is often to lead the victim to a place where a male in hiding can attack them.
In this case, the two women were acting only by themselves and committed an armed robbery with a firearm.
One of the victims was armed, too, and exchanged gunfire with one of the criminals. Sadly, the victim was killed in the exchange. The criminal had her femur broken by one of the three shots that hit her.
Bottom line: don’t let your guard down based on assumptions and also carry at all times.

16. Why smart guns are a dumb and dangerous idea


Your “smart” firearm could be disabled either by a criminal who hacks into your phone or directly into your firearm, or by the government using a secret “backdoor” to do the same.

This seminar is primarily useful to attorneys that specialize in firearms law in Virginia, but anyone wishing to pay the fee can attend.

An Arizona CHP holder was shot during a surprise attack at a Fourth of July party. He was hit on the side of the head, causing him to lose an eye. But he was able to draw his pistol and engage the attacker, killing him with four shots to the chest and saving many lives.

19. Report card on Virginia’s Congressional legislators


An embarrassing number of F grades on this report card. Gun owners need to unite and vote out those who don’t honor our rights and the Constitution!
The Firearm Industry Trade Association, released its 2022 Congressional Report Card, grading all 430 sitting U.S. Representatives (as of Aug. 8) and 100 U.S. Senators on key legislation that is of critical importance to the firearm industry, Second Amendment rights of law-abiding citizens and America’s hunters and target shooters. Five U.S. House of Representatives were not graded due to special elections to fill vacancies and have no key legislative record to review.
“This scorecard is of vital importance to voters as we head into November elections. This tells voters exactly where their lawmakers stand on issues they care about like recreational shooting and hunting and the right to keep and bear arms,” said Lawrence G. Keane, NSSF Senior Vice President and General Counsel. “This nonpartisan scorecard reflects the voting record of each legislator. These grades indicate their public voting record as well as their sponsoring and co-sponsoring key legislation, their work on committees, letters signed to support issues and leadership to support our industry.”
Several Representatives with "F" grades face challengers from excellent pro-gun rights candidates. Please do your homework and get out and support those challengers!

VCDL and GOA has filed an amicus brief in this case, which was heard in the U.S. Fifth Circuit Court of Appeals. The ruling will come out a little down the road. Listening to the audio from the courtroom, it sounded like the government attorney was having a really hard time making the case that bump stocks are machine guns. I don’t fault him. It’s hard pulling a rabbit out of a hat by defending the indefensible.

1. [DC] Victory for gun owners in DC. - 20-round carry limit is gone!


Attorney George Lyon, Dick Heller (of Heller v DC fame), VCDL member Chuck Nesby, and others just won a case against DC on the City’s arbitrary limitation of 20 rounds of ammunition that a DC CHP holder could carry on their person. The removal of that restriction is already in effect as you read this.
NOTES:
  1. DC CHP holders are still limited to magazines that can hold 10 rounds, but they can now carry as many of those as they please (up from a maximum of 1 spare magazine and 1 in the gun).
  2. Carrying on a metro in DC is still illegal (but not in VA or MD with a MD CHP).
  3. The 10-round magazine limit and carry on the metro is also being challenged, but those two items are still in progress.

Over the next few years we should see a lot of gun control being thrown on the waste heap of history. Expect the gun controllers to get even more loony than they already are.

Now that the VCDL in person meetings are back to normal, they are great.
Thursday night’s meeting was held at the new XCAL Shooting Sports and Fitness facility near Top Golf in Ashburn.
Guns Out TV is holding an all-day Range Day at XCAL on Saturday, 9/17/22 starting off with a car show at 8am. VCDL will have a table at the event, and Guns Out TV is giving away a ton of great prizes. If you want more information on this event, John Keys with Guns Out TV explains it here:
In preparation for the above Range Day on Saturday, both the Guns Out TV founder Shermichael Singleton and Guns and Gadgets YouTube host Jared Yanis were in the building and stopped by the meeting to say “hi” to the VCDL members and talked at the meeting for about 30 minutes. Jared posts videos almost every day, and sometimes more than one a day, on breaking 2A news.
Jared praised VCDL and our work and is a member even though he lives out of state. He talked about the new Heller win and magazine capacity in DC. Pat Webb and I then talked about Visa and the coding of transactions for guns and ammo etc.
Shermichael said he's trying to reach everyone of all races and colors to show that gun rights are for everyone. Not just old white guys! He looked directly at me when he said that! ;-)
Anyway, a good time was had by all. Since Philip was at a funeral, I want to thank Pat Webb for helping me run the meeting and giving a recap about the recent Top Gun VCDL-PAC Fundraiser.
The VCDL holds the in person General membership meeting on the third Thursday of every month at XCAL. (address, etc. at XCAL.com)
Sometimes people ask how they can get a VCDL meeting in their part or Virginia.
Here's how: Find a "2A friendly" venue that can accommodate 50-100 persons and a suitable restaurant close by for an after-meeting meal. Then, write to [email protected] and request a couple of dates from Philip that will fit his schedule for the meeting.
Do this all a month in advance so the meeting can then be published on social media and included in the VCDL VA-ALERT Newsletter.


2. Another possible solution to gun store sales being flagged

Regarding the credit card codes for gun stores, I believe you can use a Discover credit card as a work-around as well. It's not one of the “big three.”


3. Action item and reminder: Surry County to consider local gun control on Oct. 6!


Surry County wants to be just like Fairfax County and pass local gun-control to show its distrust of Surry County gun owners, including CHP holders.
Currently only 16 out of 194 localities have passed such an ordinance.
There’s a catch: Surry County is a Second Amendment Sanctuary and has been since 2019:

The City of Winchester and Fairfax County are both being sued over having the same kind of ordinance and the recent Bruen finding by the U.S. Supreme Court is also a very bad omen for Surry County’s proposed gun-ban.

5. Lawsuit against AR-15 manufacturers is suspicious


A lawsuit brought by GWACS Armory against KE Arms and others over alleged intellectual property violations with their AR-15 lowers is raising some eyebrows.
It appears to be at least partially funded by an investor in GWACS Armory (now defunct) who, in a deposition, said he basically sees no need for AR-15s in the hands of citizens. Further digging shows the investor might have given money to anti-gun Senator Chuck Schumer. Interestingly GWACS is seeking a gag order on information relative to the investor.
It makes one wonder if the lawsuit, which certainly looks frivolous to me, isn’t really a play by gun controllers to bankrupt some of the companies that make AR-15 lowers. I certainly wouldn’t put it past them.

7. Make fake “man with a gun” calls to police and they will find you


James Hash II of Fredericksburg allegedly made fake bomb threats and fake shooting calls, sending a significant number of Fredericksburg Police Department officers on wild-goose chases.
Mr. Hash apparently thought he could hide is identity by disguising his voice and using a “disconnected cellular device” to call 9-1-1, but the police traced the calls to his phone, nonetheless. Good work by both the Fredericksburg PD and the Stafford County Sheriff’s Office!

An election officer serves on Election Day. One day out of the year understanding it is a long day but such an eye opening experience into our USA voting system. A privilege actually to add integrity to our elections and it is easy.

The Registrar’s office has informed the LCRC that they need 150 more Election Officers for the 11/8 election. On 9/20/22 they will begin to assign the non-partisan election officers.

BREAKING! VCDL and GOA just had a MAJOR VICTORY in the lawsuit they backed against the City of Winchester!
A judge has issued a temporary injunction against the City of Winchester enforcing their gun ban in City Parks and at permitted, or should have been permitted, events!
Effective immediately, guns are no longer banned at either type of location in the City of Winchester.
This ruling does not change the gun ban in City owned buildings or, for now, at community and recreation centers.
There was another major part of today’s ruling: that the U.S. Supreme Court’s Bruen decision applies to Article 1, Section 13 of Virginia’s Constitution. Thus, determining if a gun law is constitutional under the Virginia Constitution requires showing that either the text, history, or traditions of that law were in place at the time of the Founding.
The Judge’s opinion is 42 pages long and very detailed. It will take a few days to process all of it, so we will probably have some more updates in the near future.
VCDL’s and its attorneys are deciding our next steps.

That is a big win. I hope that the judge's approach to using the Bruen analysis to evaluate whether a law violates the state constitution catches on (remember, this is just a trial court early ruling, not precedent).

3. SW Virginia will soon have no VCDL coordinator for gun shows and other events


VCDL has put out several calls over the last few months to find someone to replace Al Steed Jr as our SW VA gun show coordinator, but to no avail.
Al has done one hell of a job over the many years he has been a coordinator. If you saw a VCDL table at a gun show in Salem or Roanoke, you can thank Al. If you saw a VCDL table at a local gun store event, you can thank Al. If you enjoyed VCDL picnics in Roanoke and Salem or the occasional supper meeting, you can thank Al. If you like the annual VCDL/RRRC benefit shooting-match, you can thank Al for helping coordinate it.
But Al is well into his 80s now and wants to pass the baton to someone younger. He is trying to hang on while we wait for someone to step forward, but frankly that is not fair to Al. He has been an incredible asset to VCDL and I think he has sacrificed enough.
So, I told Al last week that if he needs to step down, to go ahead and do so and do it with a clear conscience. If we have no one in SW VA that wants to step up, then we will end our presence at gun shows and other events out there and end the semi-annual picnics.
That would all be a terrible shame, but I don’t see we have any choices unless we get a coordinator in that part of the Commonwealth.
If any of you want to volunteer for Al’s position, send me an email at [email protected] and I’ll be happy to discuss what is entailed in being our coordinator out that way. We can have more than one coordinator to keep the load down, assuming we can get two or more people who will step up to the plate.

The State is doing a study on incorporating a trail that runs through the Northern Virginia Gun Club in King George into the Caledon State Park. That incorporation would have a negative impact on the shooting range and we don’t have enough ranges, as is.

You can sign up to be an elections officer at https:apps.elections.virginia.gov/OnlineForms/OfficerofElection
To be considered for this election you must apply by 9/30.
You can go ahead and sign up now for future elections. Once accepted you can serve for 2 years. You can be an Election Officer only in the county where you vote. Virginia law says Republicans are entitled to parity. Currently Republicans only have 385 officers compared to 1,100 trained and ready Democrats. A total of 1,100 is all the registrar requires for the election. We should try to get 550 to a 550 ratio.
Training is required by the county you serve in. You get paid $150 for the day of election. It is a long - day 5:00 a.m. until after the polls close at 7:00 P.M.

You have to have a letter of authorization from your local Republican committee. When you arrive to poll watch you will have to give them a copy of your authorization letter so make several copies. Some training is required for poll watching check with your local Republican committee.

To show how far our educational institutions have fallen, JMU just awarded gun-controller David Hogg the Mahatma Gandhi Center Nonviolence award. I believe this is the same David Hogg who has suggested on Twitter that guns be confiscated from Americans in the same way guns were confiscated in Australia. Somehow, I don’t think that men showing up at your door and pointing guns at you before taking away your guns as a non-violent event.

5. Supreme Court denies cert on a bump stock case, but that fight is still alive


Even though the U.S. Supreme Court declined to hear the GOA v Garland bump stock case today (which VCDL is also a plaintiff), there is the Cargill bump stock case that is still very much alive in the U.S. Fifth Circuit.
As a reminder to those who might be new to VCDL. VCDL is not challenging bump stock bans because we love bump stocks, but because 1) they are NOT machine guns and 2) the BATFE was making a regulation without any law from Congress authorizing that regulation.

14. Virginia CHP holder saved a life in Maryland and is then charged with a crime


A marine veteran from Virginia, Lloyd Muldrow, stopped a violent attack on a third-party by a felon. Muldrow, who has a Virginia CHP and has quite a resume, was arrested along with the violent felon because Muldrow was carrying a pistol. Muldrow did not use the pistol to stop the attack. He was merely possessing it without a MD CHP.
This is a good example of why CHPs should be valid in all 50-states, just like our driver’s licenses.

1. Action Item: Surry County to have hearing on local gun-control TONIGHT, 10/6/22


The Surry County Board of Supervisors is going to meet tonight to hear comments on its plan to implement a local gun-control ordinance. The proposed ordinance will ban guns in government buildings, parks, and community and recreation centers.
We need gun owners affected by this to attend the meeting tonight, October 6, at 7 pm to speak against the proposed ordinance. I plan on being there and will bring GSL stickers.
Currently only 16 out of 194 localities have passed such an ordinance.
There’s a catch: Surry County is a Second Amendment Sanctuary and has been since 2019:

A VCDL-backed lawsuit against the City of Winchester over just such an ordinance was successful. The recent Bruen finding by the U.S. Supreme Court is also a very bad omen for Surry County’s proposed gun-ban.

  • The proposed ordinance makes a mockery of Surry County being a Second Amendment Sanctuary since 2019! The County is supposed to be protecting my right to self-defense, not taking it away.
  • How does prohibiting those who are peaceful citizens from carrying a gun for self-defense make them, or anyone else (except criminals), safer? You want to target CRIMINALS, not ME!
  • Only 16 localities have implemented such an ordinance out of 194 localities and none of them rural like Surry County. What issue has Surry County had with citizens lawfully carrying guns in the locations in the ordinance?
  • The City of Winchester has just lost a lawsuit over a similar ordinance. The recent U.S. Supreme Court ruling in the New York Rifle and Pistol Association Inc. v Bruen has made it clear that such a ban on carry in places like parks, permitted events in public areas, community and recreations centers, and other non-sensitive government buildings is unconstitutional.
Vote against proposed ordinance 20-67 and stand with the gun owners in Surry County!


2. Alexandria DASH buses to have “no guns” signs removed


Member Brian S. contacted me about seeing a “no guns” sign on an Alexandria DASH bus.
There is no enabling state law that allows localities to have such signs on their buses, so I contacted the Alexandria City Attorney’s office.
The issue was handled politely and professionally by Alexandria and concluded with the General Manager of DASH giving me a call to confirm those signs should not be on the buses and would be removed. He said carrying of firearms on buses is perfectly legal. The City had ordered six new buses and the signs were apparently on the buses when they were delivered and weren’t noticed by the City.
To make sure there were no issues with the police thinking the signs are legitimate, I called Alexandria PD and let a lieutenant know about the situation. Like the other City employees that I dealt with in resolving this issue, he was professional, polite, and pleasant. He said he would do his due diligence and confirm the situation with the City Attorney’s office before updating his officers about the signs, which is exactly what he should do. I never expect the police in such a situation to simply take my word for it.

I was interviewed by a reporter on VCDL’s gun-control plans, post Bruen.

Here’s the original article. One thing from the opposition stood out to me:
“Feldman [anti-gun Brady Campaign attorney], however, contends the ban on loaded semiautomatic handguns with high-capacity magazines isn’t unconstitutional. ‘There’s a very strong argument that the purpose of an assault weapon or a high-capacity magazine is not individual self-defense,’ she said."
But Feldman is missing a key point: The Second Amendment isn’t just about self-defense. It is also about the People being armed so they can take back the Country if the government ever turns tyrannical. Hence the right of the People to have bearable weapons of war is protected. Also, AR-15s and AK-47s are in common use, so they are protected because of that, too.

2. Update on Surry County’s proposed gun ban


The Surry County Board of Supervisors decided not to vote on their proposed gun ban until November 3, just before their Board is up for election on November 8. The updated information on the ordinance will then include exactly which buildings will have the gun ban.
20 people spoke at the hearing. 19 against the ordinance and 1 for it. The room was 2/3 full. It would have been better if it had been filled to capacity, but it is what it is. Still, the message from residents was crystal clear: don’t ban guns!
The excuse for the gun ban is that some employees claimed to be intimidated by citizens who were openly carrying firearms.
The solution to that is easy: let employees with CHPs carry at work. Campbell County does that and I’ve not heard of any issues there.
But I’m betting the ban has nothing to do with employee safety.
We need a good turnout at their next hearing.

3. R.I.P. Frank Stanisz, VCDL Chesapeake gun show coordinator


I’m sad to report that our Chesapeake gun show coordinator, Frank Stanisz, has lost his running battle with cancer. Frank was a strong 2A supporter and put action where some only put words. And he did that while quietly battling cancer! He will be missed.

Frank Stanisz, 52, lost his battle with brain cancer and went home to be with the Lord on Wednesday, October 12, 2022 at 6:20 AM. He was a Navy Veteran of 20 years. He loved to volunteer with the VCDL and he was an active member of Charity Independent Baptist Church for many years.
He leaves behind his wife, Amy; daughters, Beverly and Ciara; and his sister, Bridgette.
There will be a visitation for friends and family on Sunday, October 16, 2022 from 6 - 7 PM at Charity Independent Baptist Church, 39 Harpersville Road, Newport News, VA 23601.
A funeral service will be held on Monday, October 17, 2022 at 12 Noon at the church.
A burial with full military honors will be on Thursday, October 27, 2022 at 11 AM in Albert G. Horton, Jr. Veterans Memorial Cemetery.
In lieu of flowers, monetary donations can be given directly to the family.

6. Reminder on Virginia CHP renewal timing


Just a reminder. If your CHP is due for renewal, you must put in your renewal paperwork 90 to 180 days before your existing permit expires. If you do that your new permit will start on the date your existing permit expires.
If you renew with less than 90 days left on your existing permit, then the new permit will begin whenever it is signed by the Clerk or judge. That date may be before your existing permit even expires or it might mean your existing permit will expire before receiving the new one in the mail. The latter is one reason it is handy to have an out-of-state permit, like FL or UT, so you can continue to carry concealed in the meantime.

The woman in this story had never even fired the gun she had to use in self-defense. A life and death situation is not the time to find out the gun you have never tried had a mechanical issue when it left the factory. Or that the brand of ammunition you purchased did not work well in your gun and caused it to jam.
But the gun worked just fine and put an end to a home invasion. The invader got a trip to the hospital before heading off to jail.

13. Shocker: yet another major gun-control failure, this time in Thailand


Thailand is a gun-control utopia: universal background checks, universal gun registration, citizens cannot own semi-automatic firearms, you have to have a valid reason to own guns, and you must be at least twenty years old.
A killer murdered 36 people, mostly toddlers, and killed himself. No “assault weapon” was used, just firearms and a knife. 24 toddlers were either stabbed or shot to death, but most were stabbed. Unlike a firearm, a knife does not run out of ammunition.

Here’s the original article. One thing from the opposition stood out to me:​
“Feldman [anti-gun Brady Campaign attorney], however, contends the ban on loaded semiautomatic handguns with high-capacity magazines isn’t unconstitutional. ‘There’s a very strong argument that the purpose of an assault weapon or a high-capacity magazine is not individual self-defense,’ she said."​
But Feldman is missing a key point: The Second Amendment isn’t just about self-defense. It is also about the People being armed so they can take back the Country if the government ever turns tyrannical. Hence the right of the People to have bearable weapons of war is protected. Also, AR-15s and AK-47s are in common use, so they are protected because of that, too.​

I have to wonder whether this is true in the federal courts now. I think Scalia's invention of a "core" to the Second Amendment significantly undermined Miller v. US. In a post Heller world, do the courts even mention the author's "key point" that he claims is missing?

The third Thursday of this month is this coming Thursday, October 20, so VCDL will have its regular membership meeting at the beautiful facility at XCal in Ashburn:

We will be discussing current events related to gun rights, including the federal judge’s ruling that laws against unserialized firearms are unconstitutional and new restrictions on shipping guns. There will be Q&A, too.

2. R.I.P Mike WIlburt, VCDL statewide gun show coordinator


It’s with a heavy heart that I report that Mike Wilburt, VCDL Executive member and Statewide Gun Show Coordinator, passed away in his sleep last week. The Statewide Gun Show Coordinator is an important position that oversees all of the VCDL coordinators for the various gun shows in the state.
Mike, like our Chesapeake Gun Show Coordinator, Frank Stanisz, who also passed away last week, was fighting a serious illness for years and soldiered on selflessly fighting for our rights.
I knew Mike for many years, starting when he became our Richmond Gun Show Coordinator. Based on his knowledge of commercial sales, Mike always had the VCDL table well organized and with items labeled in a professional manner.
Eventually his health declined to where he could not lug stuff around nor stand for extended periods of time. Rather than lose him, I offered him the position of Statewide Gun Show Coordinator, all the duties of which could be done at home with a telephone and a computer.
Mike did a great job in dealing with the trials and tribulations of his position and he will be missed.

3. The stay on the City of Winchester enforcing their gun ban in parks and at permitted events is now in place until the case is litigated in court


The City of Winchester decided not to appeal the temporary stay that a judge put in place that forbids enforcement of Winchester’s ban on carry in parks and permitted or should have been permitted events.
The stay is now in place until there is a trial at some point in the future.
While the judge did not put a stay on enforcement of the City’s gun ban at recreation and community centers, VCDL will continue to support the lawsuit, fighting to add a stay to those locations, too. Recreation and community centers are not on the very short list of “sensitive” government buildings. The U.S. Supreme Court made it clear in Bruen that only some government buildings could be considered sensitive.


4. Appomattox County CHP fee expected to lower!

5. VA Supreme Court website info on self-defense laws is pretty much useless


Member Keith C. observed the following notice that has been on the back of a concealed handgun permit application for years now:
NOTICE 5 - USE OF DEADLY OR LETHAL FORCE:
FOR THE PURPOSES OF UNDERSTANDING THE LAW RELATING TO THE USE OF DEADLY AND LETHAL FORCE, PLEASE REFERENCE THE VIRGINIA SUPREME COURT WEBSITE AT Supreme Court of Virginia.

But, alas, neither Keith nor I could find any such topic on that website.
After calling both the Virginia State Police and the Virginia Supreme Court and getting nowhere, Keith finally got the information he was seeking from the Virginia Supreme Court (VSC).
You are supposed to know by intuition to put “lethal force” in the search box on the Virginia Supreme Court’s website. You are then supposed to look at all the case law that the search brings up to figure out the answer! Heck, I have a master’s degree in computer science and I still haven’t figured out how to get that search to even work.
Anyway, that is no way to run a railroad, VSC.

VCDL was trying to have a booth at the Poquoson Seafood Festival, but we decided to do the event too late for us to reserve a table.
However, Wayne and Colleen Holcomb, with Holcomb Law (Lawyer Newport News, Lawyer Yorktown), and Steve Groce stepped up and sponsored a table for VCDL! Many, many thanks to them for doing that!
It was a successful show, with the table being continuously busy for all three days!

Besides closing gun stores for trivial and innocent mistakes on paperwork, making shipping of firearms hard to do, and pressuring credit card companies to track firearm sales, they are also trying to indoctrinate future generations to fear gun ownership.
This battle will never end and there is no level too low for the gun controllers to stoop.

I was incredulous when reading the title of that article by Dean Weingarten (with the Arizona Citizens Defense League, BTW). I double-checked the calendar to make sure I hadn’t been abducted by aliens and suffered a time loss putting the current date at April 1, 2023. Nope.
It turns out it is not about any kind of magical stopping power of a .22 magnum round or a perfect hit in the eye of a bear, but the NOISE that cartridge generates when fired from a short barrel!

1. Winchester preparing to remove parks and permitted events from gun-ban ordinance, but lawsuit is moving forward regardless


The City Attorney for Winchester is preparing an amendment to the City’s ordinance banning guns in government buildings, community and recreation centers, parks, and permitted events. The amendment will remove the gun ban in parks and at permitted events. For now, this changes nothing as the City is already forbidden to enforce its gun ban in those two locations by a court order.
However, the lawsuit will continue because the City is hardheadedly keeping their gun ban in community and recreation centers, neither of which will they be able to show are “sensitive” government places when this lawsuit goes to trial.

6. Judge rules banning guns in churches is unconstitutional


A federal judge in New York has enjoined the State from enforcing a ban on guns in churches. While this is not a Virginia case, it does make it clear that Virginia’s “good and sufficient” reason requirement to carry a gun in church is unconstitutional.
VCDL will work to get that law repealed in the upcoming Virginia legislative session.

7. Biden wants to limit us to “8 bullets per round” and to institute “assault weapon” ban if Dems keep control of Congress on Nov. 8


Biden has been touting a major push for an “assault weapon” ban if the Democrats get control of Congress on November 8.
SO, GUN OWNERS AND FRIENDS/FAMILY HAD BEST VOTE ON OR BEFORE NOVEMBER 8, OTHERWISE THE INSANE GUN-CONTROL PUSH WILL CONTINUE FOR AT LEAST TWO MORE YEARS.
Biden also wants to set the magazine limit to 8 rounds, down from the 10-round limitation that he wanted before.

Joe Biden just proved what I've been saying for years. They'll start with 10 rounds and then change to an even smaller number because their goal is to ban guns, and if they can't ban guns, they make the number of rounds you can have in your gun so small it might as well be a ban on firearms.
In 1994 when the "Assault weapon" ban was passed, it had a magazine limitation of 10 rounds.
The standard capacity for an AR-15 is 30 rounds.
The standard capacity for a full-sized handgun is 17-18 rounds, 15-16 for a mid-sized gun, and 10 - 12 for a compact-sized gun.
So, where did they get this magical number of 10 rounds come from?
They made it up.
There was no size or data behind it; they just made it up.
It was completely arbitrary because the goal was to start at 10 rounds and then, over time, waddle it down.
Fast forward to 2022, and Biden is now saying you shouldn't have more than 8 rounds in your gun.
It's completely arbitrary.
The anti-you-have-a-gun politicians know the public has short-term memories, so they can say one number one day and then a different number the next.
They're going to water down the term high-capacity magazine to anything over 1 round.
By the way, the government can have as many bullets in their gun as they want.
This magazine capacity limit won't apply to the police either.
During the last "AR-15" ban any magazine that could carry more than 10 rounds had the words Restricted for LE/Govt Use Only on the magazine.
They weren't hiding the hypocrisy because they were writing the hypocrisy on the magazines.
Oh, I almost forgot that criminals would also be able to have as many bullets in their guns as they want because, quite frankly, they don't care what the law says about how many bullets they can have in their weapons.
There are more magazines that can hold more than 8 rounds than there are people in this country.
So, this juvenile idea that you're going to keep criminals from getting their hands on these magazines is foolish.

9. Member gets permit with wrong start date, causes problems


In Virginia a concealed handgun permit is valid for five years. No more, no less. Yet when one VCDL member in Newport News, whose permit was going to expire in November, renewed his CHP in June, the new permit was good for five years and five months (June 2022 to November 2027)!
Seeing that the new permit was effective before his old permit expired, the permit holder simply destroyed his old permit as not necessary.
Flash forward four months when the permit holder used his new permit to purchase two handguns. He was denied, with the Virginia State Police (VSP) telling him he needed to use his OLD permit!
I contacted the Newport News Circuit Court Clerk’s office and told them they needed to 1) reissue the old permit exactly as it was and 2) to reissue the new permit with a correct effective date in November.
Contacting VSP, they confirmed the issue was that the old permit had not yet expired and had to be used until it expired. However, they confirmed that the permit holder would not get into any legal trouble if he carried concealed with only the new permit. I was told that VSP had seen misdated permits before.
I share this as something you should check for when you renew. Make sure the permit is good for five years and no more (or no less).

If you take away the differences in the gun community, we all still have one common denominator; an inherent love of firearms.
I enjoy some parts of the gun community more than others, but I appreciate the gun community all the same.
Like America, the gun community is empowered by the burden of its diversity.
Our diversity challenges us to leave our comfort zone and deal with our weaknesses.
There are not too many things stronger than a group of different people who are devoted to a fundamental principle, especially when that fundamental principle is freedom.
The mainstream media tries to segment and pick us apart to show a lack of unity in that principle.
Unfortunately, many of us turn right around and depend on that same media to Advocate on our behalf with the "even responsible gun owners believe this" rhetoric they try.
We are our strongest advocates, which is why they keep trying to tell us what to think.
The anti-you-have-a-gun lobby knows the power we wield more than we do.
It's not about winning debates and scoring points; it's about educating on the issue.
When you talk gun rights, you're talking about an elusive obvious!
Most of it is right under people's noses and they just need someone to point it out to educate them.
With education, they get understanding, and with the understanding, we get a new member of our community.
If we can get an anti-gun person to get a firearm and be on our side, that's one less on their side, which actually doubles up our power with every single person.
The people who need to hear what we have to say remain on the other side, watching the news and growing more ignorant because of the media's intent to paint a different story.
"We the people" is what we need to get back to.
We need to show the world that "We the people" of the gun Community, are no different than anyone else.
We are law-abiding responsible citizens who choose to own a tool for sport, Recreation, and protection.
We will not back down because our freedom and our very lives are always at stake.

With Lobby Day a mere 2 months away now, I thought I’d put up this video, which is my bodycam from the massive January 20, 2020 rally in Richmond. For those who couldn’t make it, it will give you some idea of the magnitude of the event. For those who did make it, the video gives a bird’s eye view of the event from my perspective.

2. City of Winchester updated its gun-control ordinance to comply with court order


No more bans on guns in parks and at permitted events in Winchester, effective last Wednesday night. But they still have a ban in community and recreation centers, so the lawsuit will continue to trial. No date has yet been set.

3. Surry County, ignoring public input, passed local gun-control


Surry County, ignoring the overwhelming public opinion against any local gun control, and having issued a resolution in support of the 2A back in 2019, pushed through a ban in their government buildings and in community and recreation centers. Guns can be left in parked vehicles. They specifically did NOT consider a ban in their parks due to the court ruling in Winchester.
The ban is effective immediately and affects these buildings:

There is going to be a Celebration of Life Memorial for VCDL Board Member Ed Levine, who died unexpectedly at the beginning of this month.

6. Shooting at gun-free UVA prompts calls for gun control, but more were killed in knife attack at Idaho University


A shooting at gun-free UVA, which killed three and wounded two, gave the gun-control crowd another chance to dance in the blood of dead people, while calling for more gun control. Gun-free zones attract mass public shooters, but the gun control side doesn’t care. The accused murderer has been caught.
No such shootings at Liberty University, where anyone with a CHP can carry.

Winchester elected two Republicans to replace two Democrats who voted for the City’s gun ban. That leaves the balance of power closer to equal, with 5 Democrats and 4 Republicans.

Lynchburg, whose existing City Council did not vote to be a 2A Sanctuary in 2020, has three new Republicans. Two Democratic incumbents, the vice mayor and another council member, lost their races. The City’s view on the 2A is likely to change now.

You can’t make this stuff up. Two bad guys break into a house and open fire on the homeowner. Bad Guy #1 manages to shoot and wound Bad Guy #2, who, in turn, drops his gun and flees the house.
Things are looking up for the homeowner and he hasn’t even fired a shot yet!
Then the homeowner picks up the gun that Bad Guy #2 dropped before he fled and shoot and kills Bad Buy #1 with it! Something poetic about that outcome…
The homeowner didn’t have to waste money buying his own gun, he just waited for the bad guys let him borrow one of theirs!
For me, I’d still rather have my own gun that I know works and works well.

A CHP holder in Chicago shot and killed an armed robber in a store. Sadly, the robber killed the store clerk before the shooting was over. Three guns were recovered, which sounds like perhaps the clerk had a gun, too, but never had a chance to use it. The CHP holder was not harmed.

2. Update on Prince William County and gun control


I watched last week’s Prince William County Board of Supervisors (Bos) meeting where they discussed gun control. My read is that the BoS is not interested in passing local gun control or even asking the General Assembly to pass gun control. The concern seems to be centered around a rash of guns stolen from unlocked vehicles (115) this year. The resolution that was finally agreed upon that is going to the General Assembly states:
From January 1, 2022 to October 31, 2022, Prince William County had 115 guns reported stolen from a vehicle. With the increase of gun violence around the country, the County will monitor legislation and efforts that address gun violence that has been specifically instigated with firearms acquired from unsecured vehicles.

5. Democrats plan to push a ban on “assault weapons”


A handgun was used in the mass public shooting at a Walmart in Chesapeake, but that doesn’t stop gun controllers, like Biden, from calling for a ban on semi-automatic firearms.
The U.S. Supreme Court has already said such firearms are protected by the 2A since they are in common use, but that doesn’t stop the gun grabbers, either, from trying to do so anyhow.
We know that such a ban, including the one that was in place for “assault weapons” from 1994 to 2004 were ineffective:

9. Another silly article wanting the U.S. to be Australia when it comes to guns


Sigh. Michael Paul Williams wants the U.S. to be Australia. I guess he likes the idea of those without COVID shots being rounded up by the police and taken to a form of concentration camp and kept there against their will.
Sorry, Mr. Williams, but Australia does not have our Bill of Rights and they certainly don’t have a Second Amendment to protect the right of citizens to keep and bear arms.

10. And another hypocritical article blaming guns for their misuse


Shaking my head at the author, Roger Chesley.
Referring to Governor Youngkin’s comment quoted in the article, “…we have a mental health and a behavioral health crisis in the United States and in Virginia,” Chesley’s writes:
“That’s a cop-out. ‘Mental illness’ has become the default GOP explanation when a mass shooting happens – even though it was associated with just 5% of gun-related homicides between 2001 and 2010, according to a 2015 study.”
No, Mr. Chesley, calling for gun control is the cop-out! Gun control doesn’t work to stop crime, it only makes crime worse by emboldening criminals. Wishing or pretending that it would help won’t make it so.
Also, just because (and assuming your numbers are right) 5% of gun-related homicides between 2001 and 2010 were associated with mental illness, that does NOT mean that only 5% of mass-murders are associated with mental illness. I’m certain it is much, much more than 5%! Normal people don’t go around mass murdering others. If they did, trust me, you would know about it with thousands murdered in Virginia on a daily basis.
And Chesley is angry at Governor Youngkin for not jumping to conclusions instantly that these public shootings could be stopped with yet more gun control. Hats off to Youngkin for not doing so and saying that more needs to be done with mental health.

1. Reaching out to students: Announcing VCDL-U! Inaugural meeting on December 21 in Richmond


VCDL is excited to announce our newest program, VCDL University!
VCDL-U will offer young adults a comprehensive program about how to exercise and defend the right to keep and bear arms. Our curriculum will include:

2. Reminder: VCDL membership meeting in Loudoun County on Thursday


The third Thursday of this month is this coming Thursday, December 15, so VCDL will have its regular membership meeting at the beautiful facility at XCal in Ashburn:

We will be discussing Lobby Day updates, the gun control push in Pittsylvania County, firearm retention/disarming, and current events affecting our right to keep and bear arms. There will be Q&A, too.
The event is open to the public, so bring friends and family! See you there!


3. Lobby Day onsite gun storage!


Right to Bear Arms Virginia (R2BAVA), run by VCDL member Brandon Howard, will be offering secure temporary storage of your firearm while you are at the General Assembly Building during Lobby Day.
R2BAVA will be offering a prepaid reservation service and same day space-available storage service. R2BAVA’s goal, in cooperation and coordination with VCDL, is to get maximum participation at Lobby Day.
Your firearms will be secure, under the protection of armed guards near the General Assembly Building, while you lobby your delegates and senators.
Details on cost, making a reservation, and dropping off/picking up your firearm will be provided in an upcoming alert.

7. Teacher in York County arrested for having a gun on school property


From what information is available, the teacher had a handgun laying on a seat in an unlocked car on school property. If correct, that is a violation of state law 18.2-308.1, which is a felony.
To be legal, a handgun left in a motor vehicle on K-12 school grounds must be unloaded (a very stupid and dangerous requirement) and secured in a closed container (such as a glove box, console, trunk, briefcase, etc.).

8. Warren County grandmother holds suspect at gunpoint


First, and I hate to say this in a free country, is lock your vehicles when not in use!
Second, all’s well that ends well, but brandishing a gun at someone who has gotten into your unoccupied vehicle AND holding them at gunpoint while waiting for the police, is simply not a good or particularly safe idea. If the suspect decides to call your bluff and ignore your command to get on his knees, for example, are you going to shoot him?

A man tried to steal a gun from someone during a break in a concealed carry class in Las Vegas. The miscreant was confronted and removed from the facility. He then violently attacked arriving police with a screwdriver. He was shot by the police and three of the gun store employees.

We all remember the massive amount of gun control that was offered up in the 2020 Virginia Legislature. It was so radical that it spurred action from around the country, and even around the globe!
Many firearms manufacturers jumped in and wanted to help VCDL members fight off this assault on our freedom.
Among them was Hi-Point Firearms, who raffled off 50 model 995TS rifles with the VCDL logo on them! You read that right, FIFTY RIFLES! Ten entries could be purchased for $10, and the raffle sold out faster than you can empty all your mags!
Well, yesterday we received a check for the proceeds of this raffle in the amount of $19,220, which was the net amount of the proceeds. VCDL is immensely grateful to Hi-Point firearms and all who participated in the raffle. And while the battle to preserve and restore our rights will never end, it's comforting to know that we're not in this fight alone!
