So what are the laws regarding the carry of pepper spray? I ask because I want to carry a thing of bear pepper spray when I go mountain biking.

Is there a specific concern that you have? I can't think of any restrictions that would apply to carrying bear spray while mountain biking.

What the Official Georgia State Law Says
After our team searched and searched the Georgia law books, we did not find a single state law restricting the use, purchase, shipment or specification of self defense products, such as pepper spray. You are free to purchase any self defense item from our website that best fits your safety situation.

Yeah, I don't know of any state laws against pepper spray.

And chemical defensive sprays are specifically listed as one of the types of weapons that the State has preempted and forbidden any local county or city governments, or any of their agencies, boards, commissions, etc. from regulating.

See O.C.G.A. 16-11-173, and note the definition of "weapon" in subsection (f):

As used in this Code section, the term "weapon" means any device designed or intended to be used, or capable of being used, for offense or defense, including but not limited to firearms, bladed devices, clubs, electric stun devices, and defense sprays.

You have other options when bicycling in bear country, you know.
This was patented in 1896:

Does anyone know a good/reliable brand of pepper spray? I'm looking to buy some as a less-than-lethal option.

I recommend Sabre Red Mk 6 streaming pepper spray. Good OC concentration, effective, portable. I carry it daily.

Good article on choosing/using pepper spray, by Greg Ellifritz, a pretty well known personal defense/LE instructor.

Sabre Red MK6 is hard to find in stores. I suggest ordering it online.
Complete Combatant sells it, which is where I ordered mine. http://www.thecompletecombatant.com/ocpepper-spray.html

The shape of the MK6 is a little awkward to carry in some pants pockets. I used a dremel to cut off the pocket clip bc I was never going to clip and cutting it off made it sit better in the pocket. Quick deployment can be difficult from the bottom of ones pants pockets, so I reworked a IWB kydex mag pouch with a heat gun to hold the MK6 like a spare magazine. With the pocket clip cut off the MK6 is roughly the size of a double stack glock magazine.

I have a soon to be 16 year old daughter. Is there an age restriction on pepper spray carry?
In Georgia? I don't believe so... GA state law doesn't really cover sprays at all. Obviously don't take it to school, and if it's ever used it needs to be used defensively (ie. make sure the maturity is there!)

It's basically like a fist: use it defensively? cool. Offensively? That's a felony. Everyone can carry one, though.

All the dealers I have checked state 18 y/o minimum age to purchase and use. Probably has to do with selling a "weapon" to a minor. Here's a couple.

Must be a minimum of 18 years old
Cannot have any convicted felonies on record

Pepper sprays are meant for defensive purposes only and can only be sold to or used by persons 18 years of age or older.
Perhaps you can buy it and give her written permission to carry and use it.

There may be cities and states that say it's unlawful for a dealer to sell defensive chemical sprays to a teenager under the age of 18..
but Georgia is not such a place!

That said, I can understand a company having a uniform nationwide policy, especially when the issue is tort liability based in negligence. Courts are always inventing new tort causes of action as very specific fact patterns & circumstances present themselves in new cases.

That link to the pepper spray store says, without any citation to authority, that in Georgia it's illegal to buy /sell / carry / use pepper spray under 18.
That is flatly untrue.

Who comes up with feces like this?
Did they even bother researching Georgia laws or do they just pull this out of their rectal orifice?

p.S. Georgia has laws against minors being supplied with knives, guns, and even brass knuckles. But I don't see anything about minors and MACE,
OC pepper spray,
teargas spray,
or any other type of chemical defensive spray.
