Michael O’Shea, an assistant professor at the Oklahoma City University School of Law, said a case that is awaiting a decision on whether the justices will grant certiorari could be one of the most important cases in decades.

Some would question whether the court might take such a controversial case for decision during the 2008 election year. O’Shea agrees that the political consequences may be very high.

Its sad this is what the elected officials have become. Afraid to speak their mind and their beliefs. Its all about re-election.

It is sad that potential Political consequences should have any bearing at all on whether SCOTUS hears the case or not. Was it not the intention with the lifetime appointments of the Justices that they be above the political fray?
