Man Accused of Impersonating a Cop Near Ball Ground was a "Certified" Federal Agent

The Cherokee Sheriff's Office said a man accused of impersonating a cop when he pulled over a driver Monday afternoon is, in fact, a law enforcement officer. The department said the man shown on cell phone video recorded by the driver is a "certified" federal agent who was operating in off-duty capacity at the time. Words were exchanged between the officer and a citizen Monday after they crossed paths around 4 p.m. near the intersection of Highway 372 and Highway 369 in Ball Ground. Deputies with the sheriff's office were dispatched to meet with the citizen, who said a man in a silver Chevrolet Equinox "equipped with a single interior mounted blue light" pulled him over, the agency said.
Cherokee Sheriff's Office spokesperson Sgt. Marianne Kelley said the agency has notified the officer's immediate supervisor as well as his department about the encounter with the driver.
"At this point we won't say which one," she added when asked which agency the man works for.

The name of the officer was not released, but Kelley said he worked for the Department of Treasury.
Kelley said the officer made the stop after seeing a driver run a stop sign at a four-way stop and "wanted to make sure the driver wasn't impaired."
BS he never said as much in the video.

Gilbert v State found no fault in an officer using an unmarked car to pull over someone suspected of erratic driving.
OCGA 40-8-9 mandates that any motor vehicle which is used on official business by any person authorized to make arrests for traffic ... be marked.
BUT, that is not the same thing as invalidating or prohibiting a stop made by an officer, see State v. Carter, 215 Ga.App. 647, 648, 451 S.E.2d 541 (1994).
"Have a good day, sir," the unidentified officer says as he walks away. "I just want to make sure you saw me."
Two people have a bit of a dilemma about traffic courtesy.
One of them happens to have a badge and a blue light in his car, and then proceeds to detain the other driver (purely out of an 'overabundance of caution', I presume.)
I suspect that if there truly been something worthy of pulling over a driver for a traffic infraction the federal officer would be happy to wait for local enforcement to issue a traffic citation. The whole "catch and release" thing makes me think it was just someone whupping it out to compare manly measurements.

Up until 2003 the US Customs Service was under jurisdiction of the Treasury Department. Now both Customs and the Secret Service are part of the Department of Homeland Security. Customs special agents have never been able to get the the shape that guy is in. They are usually under cover too, so their badges stay in their wallets. My brother's always did anyway.
The sheriff's office wants to inform residents that when they are being pulled over during a traffic stop, officers can either be in marked or unmarked vehicles. If you feel uncomfortable, the agency recommends slowing down to below the speed limit and signal that you are trying to find a location to pull over, "as this lets the officer know that you see them."

Drivers can also call 911, and the dispatcher will be able to verify who is conducting the traffic stop. If they are unable to do this, they will also dispatch another officer to help in the matter.

Use caution," and your adrenaline rushes even higher than it did when you saw the blue light and you pull over and exit your vehicle and treasury-cop gets out of his truck with his hand on his gun and you drop him right beside his truck . . . do you go to prison?

Most likely you would, unless you have a buttload of money to hire an extremely good lawyer. We have a Legal System, not a Justice System.

Or, on second thought, was your question one to test reading comprehension? You mentioned "hand on his gun", and not "pointing a gun at you". I think that would be a determining factor, as well as whether or not he was in some kind of uniform or had a badge displayed, or if he verbally identified himself as a law enforcement officer.

Unmarked car, no uniform, no badge, no verbal notification of legal authority, no confirmation of legality from 911 call, then I think if he pointed a gun at you, a defensive shot would be legal. Simply putting his hand on his gun - very questionable defensive shot.

Cherokee County, Ga. September 27, 2017. The Cherokee Sheriff’s Office would like to inform the public that the initial report of impersonating an officer was found to be false. During our investigation we found that the male subject is employed as a federal agent with the U.S. Department of Treasury Atlanta field office. The agent is a peace officer who was driving a government issued vehicle with emergency warning devices. He was wearing his agency issued badge, but did not have on any other identifying credentials or documentation. The agent stated he initiated the traffic stop due to another motorist failing to stop at the stop sign and almost causing an accident. “The U.S. Department of Treasury became aware of the incident this morning, Tuesday, September 26, 2017, and it is under review” Special Agent in Charge Ruben Florez U.S. Department of Treasury Atlanta Field Division.

While traveling on Ball Ground Road, the Johns Creek man said he stopped at a four-way stop sign located at the intersection of Highway 372 and Highway 369, according to an initial police report with the sheriff's office.
The silver Chevrolet Equinox on Highway 369 also stopped at the stop sign traveling toward Highway 20, the report states.
The driver said both vehicles started to drive through the intersection at the same time. He said he had the right of way, but both vehicles were at a slow speed and prevented a near collision.
After continuing north on Highway 372 for about a minute, the driver said he observed the silver Equinox catching up to him "at a high rate of speed to the point he thought the vehicle was going to rear end him," according to the report.
The driver then saw blue light illuminated from the inside of the Equinox and heard the driver use an intercom system to tell him to "pull over."
After pulling over, the driver said the agent exited his vehicle, "but kept a 'shooting' distance away while keeping his right hand on a gun located on the male's hip," the report states.
This is a very busy 4 way intersection that I know well. The distance across it is large so it's very common for drivers to start moving at the same time and they will most likely wait as they approach the center if one is turning and has ROW. It is currently being revamped(I have not been through it in over a month so I don't know what all has been completed but a badly needed turn lane is being added as I understand to at least the north bound lane(I have actually texted my senator about doing that very thing over a year ago and he said it was in the works)).
