Hypothetical Question

    Let's say you are at an establishment such as a McDonalds or Starbucks where it is legal for you to carry and a LEO sees your firearm. If he asks you to leave because he thinks you are not allowed to be there do you have to leave even if the manager doesn't ask you to leave? Just curious of what one would be required to do.

    Politely request to speak to the shift supervisor (police, not McD's).

    IF you want to fight about it.

    Well, ok, I am not your lawyer, you have not paid me to represent you, this is not a researched answer, and nothing I ever post here is legal advice, and you should not take it as such.

    You have to be careful. The criminal trespass laws state that you must leave within a reasonable time (how long is that?) after being requested to do so by an agent of the property. If the LEO is working for McDonald's off duty - then guess what? Agent for the property.

    If the officer is just eating lunch, then I would refuse.

    Refusal WILL get you instantly Tasered.

    Or at least that is what I am starting to think.
