I was reading a thread pertaining to those people exempt from the requirement of a GFL to OC or CC, and it got me wondering.


O.C.G.A. § 16-11-130
Exemptions from Code Sections 16-11-126 through 16-11-128
......
(3) Persons in the military service of the state or of the United States;

If one is a member of the Georgia Defense Force, which is under the command of the governor, would this code be applicable to you?

BTW, just joined GCO. I've gotten very interested in 2A issues and have convinced everyone in my immediate family to buy a gun and get their GFL. Next step is to get them to contribute to the cause!

Interesting thread...thanks. It seems like an interesting avenue to explore, but like most people stated, I wouldn't want to be the test case. Have there been any cases decided pertaining to regular military carrying? Would this decision be applicable to a GSDF member? I'm beginning to wish I had gone to law school.

Our judges don't even know what the law means. I doubt going to law school would help :(

Every thread on this board has come to the conclusion that GSDF members are covered by 16-11-130. They are certainly in the military service of the state.

I would not recommend joining just to get this exemption because there is more of a commitment than just signing up and showing up a few times a year.

The Georgia State Defense Force is a legally constituted element of the Georgia Department of Defense, serving in support of the national and state constitutions under direction of the Governor and the Adjutant General of the State of Georgia.
