A friend of mine did a FOIA request for a 911 call regarding an incident in which they were the caller / complainant. The request was denied due to the case remaining subject to a pending prosecution. Is this legit or an overzealous interpretation of the law?

If your friend was arrested, his attorney will probably get it in discovery. Otherwise, he will have to wait until the case is closed.

(a)(4) covers documents related to law-enforcement investigations for any pending criminal matter (that would include audio recordings as well.)
