    This was the court of appeals. Are you suggesting the Supreme Court would reverse this? They don't even take gun cases, so that doesn't seem like a big worry.

    It is possible, however, the 9th Circuit could take the case en banc, which a few years ago would have been almost inevitable. But Trump has put a few judges on the 9th Circuit who might not be as read to vacate this judgment.

    Right now, there are 827 specific makes and models of handguns on the California D.O.J. "approved" list. The manufacturers or importers of these guns have submitted samples to California for safety testing, to be test-fired for reliability and being drop-safe, and to confirm they have a manual safety.

    That's very nice but over 1,100 handgun models (my best estimate, I'm not counting them all) have been removed from the approved list.

    And models will continue to drop off the approved list because any time a manufacturer makes ANY change (as simple as a slide color change or an actual safety improvement) to an existing approved model it gets deleted. Why? Because the "new" model must have microstamping technology incorporated into the gun in order to be CA legal. And no manufacturer currently can, does or will do it. So the approved list will continue to shrink until manufacturers do (unlikely) or the stupid microstamping law is overturned (unlikely).

    I was told that's why h&k sends most of their usp pistols to California because it's the only gun they have approved there...

    On the same day the court ordered the appellees to respond to the petition within 21 days.
