He charged that Police Commissioner Ray Kelly's decision not to let him carry a gun is a violation of his constitutional rights.

[Federal District Court] Judge Sidney Stein disagreed, noting the commisioner has the power to prevent ordinary citizens from carrying guns and therefore can prevent one of his employees from being armed.

ok, I'll bite. How does the police commissioner have the power to take away constitutional rights?

I suspect that Kenny-No-Gun was a crappy cop to start with and his boss found a good way to make him quit. Even if he doesn't quit, he still looks pretty silly. The bit about possible liability if Officer Kenny were in another shooting was pretty good. PC can be good sometimes :D

And sometimes justice works in mysterious ways. 8)
