What is the legal definition in GA of brandishing a firearm?
There isn't one. There's no mention of "brandish" or brandishing" in the entire state code.
The closest thing I could find is:
try aggravated assault.
"Assault" means to do something that puts another person in fear that they're about to receive a violent injury.
An assault is "aggravated" if it involves the use of a "deadly weapon." All firearms are deadly weapons.
Are you "using" a gun to instill fear in somebody if you make a verbal threat against them while lifting your shirt to show them that you're packing? Maybe. If a jury says "yes" and convicts you, the Court of Appeals won't second-guess them.
