I have a quick question. I own a DPMS LR-308 AP4. It has a 16" barrel. It does not fit in the defined long gun category 18-26" barrel. What category does it fit in for Georgia and what laws would apply to it?

Ar eyou talking about GA laws for owning, for carrying, transporting, keeping it in your car?

I was not really wondering about owning. Lots of people have rifles with 16" barrels here in GA. It is just a range gun for me right now. It could possibly be a hog hunting gun at some point. I would like to know what laws or where to look for what laws would apply to it as it does not fit in any category. These would be applying carrying, transporting, and keeping in vehicle.

No law against it, so it must be legal. :mrgreen:

As far as keep it in your vehicle or carrying it is concerned, it's not regulated. It is not classified a long gun, pistol or weapon.

As others have said. If something is not defined as being illegal, it's legal. 16" rifles are currently unregulated by OCGA 16-11-125.1 through 16-11-135. This means, in theory, you are legal in Georgia as long as you do not carry one into a place restricted by Federal law.

My advice, just use common sense. If someone tries to walk into a courthouse carrying a loaded AR-15, they are going to get proned, arrested, and even though they may win in court, enough attention will be drawn to this hole it's going to get closed up first thing come January.

I prefer to look at it this way. If I accidentally wander to an otherwise off limits place with a 16" AR-15, I have the 2" gap keeping me legal.

Perfectly legal for range and hog hunting, as well as carrying, transporting, and keeping in your vehicle, assuming you are not a felon or otherwise a prohibited person. I hope that answers your questions.

Firearms or other deadly weapons are regulated in other Code sections besides 16-11-125 through 135.

If a 16" or 17" barreled carbine is not at all regulated under some Code sections, it may still be for others.

The definitions section that created this loophole doesn't apply to the entire Code of Georgia.
