I haven't been able to find a thread that speaks to this rather specific circumstance.
I have an acquaintance who is a spouse of an Army officer stationed here in Georgia. They have decided for tax purposes to maintain Washington state drivers licenses for now. They own a home here in Georgia and reside here. She has a Washington state carry permit that is current.
Is there any possible way for her to get a nonresident permit (Florida maybe?), and that would allow her to legally carry here in Georgia?
That depends. Are they maintaining the Washington State address or just their drivers license? IF the address on their license is their actual address and not just one they are using to keep their license then any non resident permit that is accepted in GA will do just fine.
If on the other hand the address on their license is just one they are borrowing from friends or family and their real address is here in Georgia then it's called tax fraud. Just because Stacey Abrams got away with it does not mean anyone can.
I did some more research. She is a military spouse and is covered under the Military Spouses Residence Relief Act, which allows her to maintain the same legal residence as her husband, which is Washington state. She keeps her WA DL and carry permit, keeps her car registered in WA, and absentee votes in Washington. That leads me to believe she is still a legal Washington resident, even with a Georgia home that they own and that they live in. So, in theory, she can get a Florida non res CCW, and carry on that here in Georgia. It would sure require some explaining, if her legal carry status were ever in question. I would be hesitant to rely on all that, if it were my wife.
I "think" it would still come down to who actually owns the Washington residence. Do they actually own it or do they just borrow the address to keep their Washington license as stated before for tax purposes. Sounds a lot more like tax fraud than something legit.
To focus on a direct answer to the question I don't see any reason they could not get a Florida Non-res and use it. That is unless for some reason Florida does not issue to residence of Washington.
I personally would not get involved without more information about the Washington residence. There is nothing wrong with having multiple residences in more than one state. If the residences actually belong to those using them. If they are just borrowed from friends or family for "tax purposes" then I think it does become tax fraud. Like I stated before just because Stacey Abrams got away with it does not mean everyone can.
